At Mom.com, we are committed to maintaining your privacy and your trust. This Privacy Policy explains how we collect, protect, use and share information about you when you visit the Mom.com website ("Site") and use the services found on the Site (the “Services”). We hope this information increases your confidence in Mom.com and enhances your experience on our Site. This Privacy Policy is incorporated into and subject to the Terms of Service. Each time that you visit the Site or use our Services, you signify that you agree to be bound by the Terms of Service and this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you must discontinue using the Services and terminate your membership.

INFORMATION WE COLLECT

User Provided Information.

Mom.com collects personal information from you when you perform certain activities on the Site, including: signing up for emails, creating an account, updating your account and making a purchase. At any time when we ask for you to voluntarily provide information, you’ll be provided with a form that shows the information we are requesting from you at that time. Some information may be required, whereas other information is optional. If you do not wish to provide any of the mandatory information, you will not be able to engage in activities on Mom.com that require that information. For example, if you want to sign up for Mom.com email newsletters, you’ll be asked to provide your email address and zip code. If you want to make a purchase, you’ll be asked to provide your credit card number, expiration date and security code, as well as your billing address.

From time to time we may ask you to respond to surveys or other requests for information and, we collect the information you provide. We may also collect information about you from third parties, including verification services, data services, as well as public sources. We use this information to continually offer you the most value as a Mom.com member.

All personally identifiable information that we collect may become part of your Mom.com member file and may be used by Mom.com as provided in this Privacy Policy or as disclosed at the time you provide the information or as otherwise agreed by you. If you provide personally identifiable information to the Site, you acknowledge and agree that such information may be transferred from your current location to the offices and servers of Mom.com and the authorized third parties referred to herein located in the United States.

Web Logs

Like most standard website servers, we collect information from all visitors to the Site. This information may include the browser you are using, the internet address from which you linked to our Site, the operating system of your computer, the unique IP address of the computer you used to access our Site, and usage and browsing habits. We use this information to help diagnose and troubleshoot server malfunctions, to analyze trends, track user movement in the aggregate, and gather broad demographic information. We may also use individual information we collect through web logs to send you targeted offers and other communications.

Cookies

To help make sure you receive information that is relevant to you, our Site uses data "cookies." We use session cookies to make it easier for you to navigate our Site. A session ID cookie expires when you close your browser. We use persistent cookies to differentiate visitors to our Site from members, to customize the content of certain sections of the Site and to enable us to track and cater to the interests of users, in order to enhance their experience on the Site. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser's "help" file. Cookies help us learn which areas of our site are useful and which areas need improvement. We will not use cookies or other data capture mechanisms to collect any personally identifiable information about you, except with your permission. Web Beacons

Our Web pages and our e-mail newsletters contain “web beacons.” Web beacons allow us to count users that have visited a web page or opened an email that contains a web beacon and collect other types of aggregate information. Using this information, we are able to understand how visitors and members use our Site. This allows us to learn what pages are most attractive to our visitors, which parts of our Site are the most interesting and what kind of offers our members like to see. Some of the web beacons that are in place on our Site are used only by Mom.com, and other web beacons are from our service vendors who use this data to assist us in analyzing how our members use the Site. In addition, we have agreements with various third parties that promote Mom.com on their websites. These sites may use web beacons in their advertisements to track users who click through from their website to Mom.com.

Advertisers

Mom.com may also allow advertisers and other third parties to use web beacons and cookies to track the effectiveness of their campaigns and other activities.

Supplemental Information

We may supplement information you give us with information from other sources, such as information to validate or update your address, payment card or other demographic and lifestyle information. We use this information to help us maintain the accuracy of the information we collect, to enable us to fulfill our products and services, to target our communications so that we can inform you of products, services and offers that may be of interest, and for internal business analysis or other business purposes. In the event that additional information is requested from a member to support a claim made under a specific benefit provided, we will use this information to validate the nature of the claim. This may include contacting the merchant to verify that a voucher was redeemed.

Aggregated Personal Data

In an ongoing effort to better understand and serve the users of the Mom.com Services, Mom.com often conducts research on its customer demographics, interests and behavior based on the personally identifiable information and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Mom.com may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

HOW WE USE YOUR INFORMATION

Mom.com is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your personally identifiable information with certain third parties without further notice to you, as set forth below:

With Merchants

We provide offers from merchants who, as part of the offer, request information on Mom.com customers who purchased their offers in order to aid redemption and for us to track voucher redemption. In those cases, we share some of your personally identifiable information with those merchants. However, we will only share personally identifiable information with a merchant if you have expressed an interest in that merchant's goods or services and do not share your email address with any merchant unless you opted in to receive emails from that merchant. However, keep in mind that once you redeem an offer from a merchant, you become a customer of the merchant that is fulfilling the offer and at such time we will not have control over that merchant's use of the personally identifiable information that you provide to them when you accept the offer. Your information will be subject to the respective merchants' privacy policies and we specifically disclaim any responsibility or liability for the actions of such merchants whose activities are not within our control.

Email and Newsletters

Mom.com may send you offer-related emails, purchase confirmations and other emails from time to time. We may ask you which emails you wish to receive. You may change your email preferences (i) at any time by simply updating your account, which you can do by clicking on the "My Account" button posted throughout the Site, or (ii) by opting-out of receiving future emails as described at the bottom of each communication from Mom.com.

Sweepstakes and Promotions

On occasion, we may offer sweepstakes and other promotions in conjunction with a sponsor. By participating in a promotion, you submit to that promotion's terms and conditions including providing us with permission, if required, to share your personally identifiable information with a particular sponsor and to file winners' name and addresses for the purpose of state filings required by law.

Tell-A-Friend/Buy it for a Friend

If you become a member of Mom.com you can also invite other individuals to join by providing us with their first names and email addresses. Using the information you give us on these potential members, we will send them an email invitation to join Mom.com. The only way these individuals can become members, however, is if they come to our Site and sign up themselves. We do not use this information for other purposes.

If you choose to buy a deal for a friend, we will ask you for your friend's name and email address. We will automatically send your friend an email notifying them of the gift you bought for them or inviting him or her to visit the Site. We store this information for the purpose of sending the notification, sending the gift, and tracking the success of our referral program. Your friend may contact us using the Contact Us form to request that we remove this information from our database.

Remarketing and Third Party Ad Servers

Remarketing is a way for us to connect with users, based upon your past interactions with the Site. Third-party marketing vendors may be hired by us to perform remarketing services. As a result, third-party vendors may show Mom.com ads on sites on the internet and may use cookies to serve ads based on a user's prior visits to the Site. We may also use third party advertising technology to serve ads when you visit our Sites and outside ad-serving companies to serve advertisements across the internet and on our Sites. They may collect anonymous information about your visits to the Sites and your interaction with our Services and information about your visits to other websites to target advertisements for goods and services. This anonymous information is collected through the use of pixel tags or cookies, which are technologies, used by most major websites. Legal Matters; Safety

We may, without your consent, access and disclose your information, any communications sent or received by you, and any other information that we may have about you or your account as may be permitted or required by law (including, but not limited to, court order or subpoena), or to comply with a legal obligation, or to prevent or investigate suspected fraud, violations of our Terms of Service, or activity that appears to us to be illegal or may expose us to legal liability. Additionally, we may disclose your information in situations that we believe to be emergencies involving potential threats to the physical safety of any person or property if we believe that your information in any way relates to that threat.

Sale of Business or Assets

In the event that Mom.com, substantially all of its assets, or a line of business is sold or disposed of as a going concern, whether by merger, sale of assets or otherwise, or in the event of an insolvency, bankruptcy or receivership, personally identifiable information of our members may be one of the assets sold or merged in connection with that transaction. Information about our members may also need to be disclosed in connection with a commercial transaction where Mom.com or an affiliate, is seeking financing, investment, support or funding. In such transactions, personal information will be subject to the promises made in any pre-existing Privacy Policy in effect when the information was obtained.

Other Service Providers

We may use other third party vendors to provide services on our behalf and therefore may share your personally identifiable information with such service providers to fulfill orders, send postal or email messages, administer contests or sweepstakes, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the Site, troubleshoot, and provide customer service. Our service vendors maintain that they only use your personal information to provide the relevant services to us and they will not use your information for any other purposes. However, the use of your personally identifiable information by such parties is not subject to our control.

IMPORTANT DISCLOSURES, PRACTICES AND CONTACT INFORMATION

Mom.com Contains Links to Other Sites

It is possible for you to receive information directly from our partners and other companies if you access them through a link on Mom.com or if you go directly to their websites. Once you are on their sites, any data that you supply to these partners, for example, to obtain information or buy products directly from them, is beyond our reach and will be the responsibility of each of the linked-to entities and not Mom.com. We are not responsible for the privacy practices or the content of these websites or any other sites linked to or referenced on our Site.

In addition, Mom.com allows you to “share” certain content with your connections on other websites such as Facebook and Twitter. By using this share functionality, Mom.com content may be associated with your personal information on those sites and will appear in the “newsfeed” of your account on those other sites.

Security

Mom.com has multiple layers of security on its systems. We have implemented software and hardware security, including firewalls, data encryption, and private networks intended to protect your personally identifiable information from unauthorized access. We use firewalls and intrusion-detection devices that are designed to defend against hackers and notify us if any attempts are made to compromise our network. We regularly review additional software upgrades in an effort to enhance our security measures. However, despite our efforts, no system can completely guaranty that there will never be unauthorized access to your personally identifiable information, and your use of the Site indicates that you are willing to assume this risk.

A Note about International Users

The Site is hosted in the United States. If you are using the Site from outside the United States, by providing your information to this Site, you are consenting to the transfer of your information to the United States for processing and maintaining in accordance with this Privacy Policy and our Terms of Service. You are also consenting to the application of United States law in all matters concerning this Site.

Children's Privacy

Mom.com does not encourage participation or visitation by children. Visitors who are known to be under the age of 18 are prohibited from becoming Mom.com members.

Your California Privacy Rights

Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal customer information we share with third parties or corporate affiliates for those third parties or corporate affiliates' direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to the address referenced below.

Exclusions

This Privacy Policy shall not apply to any unsolicited information you provide to Mom.com through this Site or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, such as bulletin boards (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Mom.com shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

Updating Your Personal Information

If you are a Mom.com member, you can update your personally identifiable information at any time. To do this, just click on the "My Account" link listed throughout the Site. If for any reason you are concerned that the personal information you provided to us is not correct and you cannot change it by accessing your account, or should you wish to have your email address removed from our mailing list or contact information changed, please contact us using the Contact Us form. We will be happy to review, update or remove information as appropriate. If you deactivate your account or change personally identifiable information, we may still retain prior information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, resolve disputes, enforce our Terms of Service or other policies, take actions we deem necessary due to technical and legal requirements and constraints related to the security, integrity and operation of our Site. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties' policies.

WAIVER

MOM.COM ASSUMES NO RESPONSIBILITY OR LIABILITY WITH REGARD TO ANY THEFT, LOSS, ALTERATION OR MISUSE OF PERSONAL OR OTHER INFORMATION LAWFULLY PROVIDED BY MOM.COM TO THIRD PARTIES, OR WITH REGARD TO THE FAILURE OF ANY THIRD PARTY TO ABIDE BY THIS PRIVACY POLICY OR AGREEMENT BETWEEN THAT THIRD PARTY AND MOM.COM.

Changes to the Privacy Policy

We may change this Privacy Policy from time to time without prior notice. The most recent version of the Privacy Policy will always be posted on the Site, with the "Effective Date" posted at the top of the Policy. We may revise and update this Privacy Policy if our practices change, as technology changes, or as we add new services or change existing ones. If we make any material changes to our Privacy Policy or how we handle your personal information, you will know because the Effective Date of the Privacy Policy will change. If we are going to use any personal information in a manner that is materially different from that stated in our Privacy Policy at the time we collected such information, we will give you a reasonable opportunity to consent to the change. If you do not consent, your personal information will be used as agreed to under the terms of the privacy policy in effect at the time we obtained that information.
